Minnesota Court Denies 3M Injunction Against Avery Dennison

Chief Judge Michael J. Davis of the U.S. District Court of Minnesota denied 3M’s preliminary injunction that would’ve blocked Avery Dennison from selling its OmniCube™ retroreflective-sheeting material. The preliminary-injunction motion was part of a patent-infringement lawsuit filed against Avery Dennison in June. Davis reportedly stated that Avery Dennison had raised a substantial question of validity with respect to the patents at issue and, according to the Court, “based on the likelihood of success on the [case’s] merits and that 3M will be irreparably harmed, the balance of harms and public interest tips in favor of Avery Dennison.”
