ILight Prevails in Patent-Infringement Lawsuit

Federal jury finds Fallon infringed on three LED-lighting products

iLight Technologies Inc. (Chicago), a company that provides LED lighting solutions, is announcing that, on April 30, 2009, a jury in Federal Court unanimously found that Fallon Luminous Products Corp. willfully infringed multiple claims in three iLight patents that pertained to ways of simulating cold-cathode or neon-lighting that use, among other technologies, LEDs. The jury also unanimously confirmed that those claims of iLight’s patents weren’t invalid, as Fallon had contended.

The jury concluded iLight was entitled to a multi-million dollar award of compensatory damages. As a result of the jury’s finding of willful infringement by Fallon, the judge increased the amount of damages awarded by the jury by $1 million. The court issued an injunction order prohibiting Fallon and all acting in concert with Fallon from using, manufacturing, importing or selling any of Fallon’s infringing LED products.

“Since its inception, iLight has invested significant resources in developing and delivering unique and leading-edge LED lighting technologies for our customers,” stated Mark Cleaver, iLight’s founder and chairman.

Elizabeth Randgaard, iLight’s marketing director, said, “While intellectual property is a complex arena that many end users and resellers, such as sign companies, may not consider, many sign companies may not be aware of the legality of the LED products that they are promoting and reselling to their customers. For larger sign companies that may manufacture their own LED solutions for client-specific projects, awareness of patents issued is even of more importance.”
